PRIVACY POLICY OF LUDDITECH INC.

  1. INTRODUCTION

    • The terms whose first letter is capitalized in this Privacy Policy (hereinafter the “Policy”) are defined in Ludditech's Terms of Use. We recommend that you read it.
    • In the face of new challenges and dangers related to maintaining the security of personal information arising from online commerce, it is necessary to pay special attention to privacy protection. That's why Ludditech is seriously concerned about the confidentiality of your personal information and commits to respecting the confidentiality of the information it collects. Ludditech commits to adhering to, in accordance with this Policy and the laws applicable in Canada and Quebec, the obligations related to the collection and processing of your personal and confidential information, obtained in the context of operating its business, so that everyone can benefit from the respect for their privacy. In this context, Ludditech wishes to ensure the accuracy, security, and confidentiality of your personal information, and not to collect, use, or disclose your personal information otherwise than in accordance with this Policy and the applicable laws.
    • The Policy describes the information that Ludditech may collect from its Users in the context of its activities. The Policy also describes, among other things, how Ludditech collects, processes, stores, and uses your information and the circumstances in which it can be transferred to third parties. The Policy explains your rights regarding the collection, use, and disclosure of your personal information.

  2. SCOPE OF THIS POLICY

    • We collect your personal information as part of our mission to provide you with a platform that allows Fizlers to group their Clients for free, by making available tools for managing the service performances of said Fizlers. Fizlers and Clients may collectively be referred to as “User(s)”.
    • By navigating on Fizl, using the Services of Fizl, or subscribing to our email publications, the User accepts the terms and conditions of this Policy. You agree that your personal information collected when you fill out an online form for the purpose, among others, of making Payments, downloading content from Fizl, or acquiring other services related to products available on the site, be transmitted to the appropriate and authorized staff of Ludditech. Ludditech will only disclose to third parties whose involvement is strictly necessary for the delivery of services and/or the maintenance of our business relationship with you, where applicable, the information necessary for these purposes (the aforementioned third parties may collectively be referred to hereinafter as “Third Party Providers”).
    • By providing Ludditech with your personal information, you authorize Ludditech to use and disclose such information to Third Party Providers, as appropriate, in connection with the delivery of products, the administration of our contractual relationship, our business relationship with you, and in accordance with this Policy and as permitted or required by law, as well as implicitly, if circumstances so indicate. In addition, Ludditech will ask for your permission before using your personal information for purposes other than those to which you originally consented under the Policy. Finally, you may withdraw your consent at any time, subject to legal and contractual restrictions and a reasonable notice. Please be aware, however, that without your consent, Ludditech may not be able to provide or continue to provide you with some of the services or information that may be useful to you.
    • If you provide Ludditech or its Third Party Providers with personal information about another person or entity, you agree that you have the necessary authorization to do so and/or that you have obtained all necessary consents from that third party to allow us to collect, use and disclose their personal information for the purposes set out in this Policy. To withdraw your consent or stop receiving electronic communications from us, please write to the following email address: support@fizl.io.

  3. COLLECTION OF PERSONAL INFORMATION

    • Personal information is data specifically associated with an individual that can be used to identify them, either alone or in combination with other information that Ludditech may have access to. Information that has been anonymized or arranged so as not to identify a specific individual is not considered personal information. For example, a person's office postal address is not personal information unless it is mentioned with other information about the person, or if its mere mention reveals personal information about them.
    • Ludditech may obtain personal information from the User when they register personal information on Fizl or, where applicable, by providing other personal information, notably by creating a user account and entering a unique confirmation code received on their phone, filling out a form to make a Payment, logging in as a registered User on Fizl, conducting a product or service search, providing account information, contacting us by phone, email, or otherwise, or by filling out a form to participate in a contest, an inventory request, a promotion, or a survey. By filling out such a form, you authorize us to collect your personal information.
    • We may collect the following information from Fizlers, both upon their registration and during their continuous use of Fizl or Fizl's Services:
      • Full names;
      • Age;
      • Phone number;
      • Email address;
      • Banking information;
      • Profile picture;
      • Personal description;
      • Languages spoken;
      • Official identity document copy (for identity confirmation);
      • Notification settings;
      • Feedback regarding Fizl or Fizl's Services; and
      • The User's willingness to receive promotional or non-promotional communications.
    • We collect the following information from any Client who uses Fizl's Services or payment services, as well as during their continuous use of Fizl:
      • Billing information;
      • Payment information; and
      • Reviews on Fizlers.
    • In general, we may also collect your location, IP address, and data on your use of Fizl, Fizl's Services, and any other information that allows us to provide our services most appropriately.
    • User information is also collected through interaction that can be established between the User and Fizl – as mentioned above – and may be used for the following purposes:
      • Understanding the User's use of Fizl;
      • Improving the Fizl and Fizl Services;
      • Provide services to the User;
      • Manage User accounts;
      • Manage relations with Users and commercial relations;
      • Provide personal information to business partners;
      • Comply with compliance laws and regulations;
      • Send newsletters;
      • Send promotions tailored to the User's needs;
      • Allow access to the Fizl;
      • Enabling Payment;
      • Enabling Withdrawal;
      • Provide customer service;
      • Detect and prevent fraud, spam, abuse, security incidents and other harmful activities
      • Investigate and combat discrimination
      • Conducts security investigations and risk assessments
      • Verify or authenticate the information provided by the User
      • Conduct database checks and other sources of information, including background or police checks
      • Perform analysis, debugging, research
      • Send messages, updates, security alerts, and account notifications
      • Personalize the user experience based on interactions with the Platform, service history, profile information and preferences, and other content submitted by the User
      • Invite the User to events or other occasions
      • Analyze features and preferences in order to send promotional and marketing messages, advertisements and other information that may be of interest to the User
      • Manage prizes, surveys, contests or other promotional activities or events organized or managed by Ludditech or its business partners
    • The User’s personal information will not be retained beyond the purposes for which it was collected. Ludditech complies with the retention period established by this Policy, which is in accordance with applicable privacy laws. The deletion of the data occurs once the User deletes his account. The User will then have thirty (30) days to recover his data, otherwise, Ludditech will delete them permanently.
    • Ludditech may also compile lists of your names and postal addresses for philanthropic, anonymous statistical or market research purposes. If you do not wish your names and postal addresses to be compiled for these purposes, please contact us at support@fizl.io.
    • The deletion of personal information is done at the written request of the User at the above address. Ludditech reserves the right to refuse a User's request when the User's continued use of Ludditech's services complies with the retention period established by this Policy, which is in accordance with the Act Respecting the Protection of Personal Information in the Private Sector. Accordingly, and unless otherwise provided in the regulatory framework, the deletion of data will be effective thirty (30) days after the Privacy Officer has processed the request for deletion of personal information.
    • Fizl is designed for use by adults only, as understood in the Province of Quebec. Ludditech does not knowingly collect any personal information from anyone under the age of eighteen (18). Where applicable, the information is collected from the child's parent, guardian or teacher. Fizl is not designed for persons under the age of eighteen (18).
    • For more information on the protection of the User’s personal information and his related rights, the User may contact the Office of the Privacy Commissioner of Canada or the Commission for the Protection of Privacy of Quebec.

  4. FORMS AND INTERACTIONS

    • Ludditech collects your personal information in accordance with legal requirements. Whenever possible and appropriate, we collect your personal information directly from you or from the individuals you have chosen to provide us with your personal information.
    • The User’s personal information may be collected through forms, namely:
      • Registration form for Fizl;
      • Resource download form;
      • User profile update form;
      • Form for Payment Services Payments;
      • User’s Authorization of access to his information; and
      • Contact form.
    • Your basic personal information, such as your email address, surname, first name and phone number, may also be collected on Fizl, including by email.

  5. ADVERTISING INFORMATION

    • Ludditech will contact the User only if he wishes.
    • If the User does not subscribe to our newsletter, does not have a business relationship with Ludditech or has never purchased one of our products, he will not receive any email from Ludditech without his prior consent.
    • If the User prefers not to receive any advertising information from Ludditech or if he does not want Ludditech to use his personal information to enhance his customer experience, please let Ludditech know by contacting us at the contact listed in the section “Right of opposition and withdrawal”.
    • Remember to include the User’s full name and the e-mail address he used when he registered or when he made a purchase from us. There may be a delay in processing time for a request sent by e-mail or traditional mail and the User may continue to receive communications from Ludditech in the meantime.

  6. ANTI-SPAM LEGISLATION

    • Ludditech complies with the dispositions of the Canadian Anti-Spam legislation (CASL).
    • The User understands that he or she may expressly or tacitly consent to receive messages from Ludditech.
    • Express consent is the consent sought from the User, which must be stated in clear and plain language, and must include the purpose for which consent is sought, prescribed information identifying the person seeking consent and, if consent is sought on behalf of another person, prescribed information identifying that individual; and any other information specified by regulations made under this Act.
    • The User understands that he gives his tacit consent during the existing business relationship or the existing non-business relationship; when the User publishes his e-mail address without mentioning that he does not wish to receive unsolicited commercial electronic messages; or when the message is sent in the other circumstances provided for by the regulations under this law.
      • For the purposes of this Policy, “existing business relationship” refers to a business relationship between two persons, such as a purchase or lease within two years prior to the date the message is sent; an investment or game offered, the bartering of a thing, any contract in effect or expiring during that period, or a request within six months prior to the date the message is sent.
      • An “existing non-business relationship” is defined as a relationship between two persons other than a business relationship, such as a gift or donation, work done as a volunteer, and a membership, as defined in the by-laws; all within the two years prior to the date the message is sent.

  7. PROTECTION AGAINST FRAUD AND THEFT OF YOUR PERSONAL INFORMATION

    • Ludditech undertakes at all times to comply with the laws and regulations applicable to its activities and to take all necessary and useful measures to detect and prevent negligence, fraud and theft of your personal information. However, although Ludditech takes precautions, Ludditech cannot guarantee that no fraud or theft of your personal information will occur.
    • Ludditech maintains a record of privacy incidents and will contact any User whose personal information is subject to such an incident and presents a risk of serious harm.

  8. THIRD-PARTY ADVERTISING DISPLAYED ON FIZL

    • You may find third-party advertisements displayed on Fizl. We do not allow third parties to collect your personal information on Fizl without your consent.
    • Ludditech prohibits and is not responsible for the resale or use by third parties of opt-ins obtained through Fizl by these third parties. If you have agreed to share your contact information with partner organisations, we will share it with them.
    • We do not sell or rent your personal information without your consent.

  9. THIRD-PARTY SERVICES

    • Ludditech may use third-party services for the management of its business and Fizl. In no event shall Ludditech be held liable for any prejudice that may arise from such third-party services. Ludditech invites the User to consult these services’ respective websites, in order to learn about their conditions of use.
    • Ludditech prohibits and is not responsible for the resale or use by third parties of “opt-ins” obtained through Fizl by event organizers. If you have agreed to share your details with partner organizations, then we will share it with them. We do not sell or rent our listings.

  10. AUTOMATICALLY EXCHANGED DATA

    • Through the use of cookies, we collect certain information during exchanges between your computer or phone and our server. Cookies are files created by a website that record information about your computer or phone's navigation on Fizl. They are automatically stored on your electronic devices, allowing you to connect to Fizl later on and enabling Ludditech to personalize Fizl Services.
    • This information consists mainly of the following:
      • Domain name;
      • IP address;
      • Browsing history; and
      • User's language.
    • Most of the information automatically transmitted does not allow for the identification of the User. It is collected solely due to the technological requirements inherent in Internet browsing. Most browsers automatically accept cookies, but it is generally possible to modify this behavior. However, if the User chooses to refuse cookies, they may not be able to log in or use certain features of Fizl or Fizl's Services.
    • The use of this information allows us to improve the service, personalize the User's experience, and better track your past use.
    • In addition to the methods described above, we may also collect information through cookies or similar technologies, particularly during your visits to Fizl. These methods allow us to collect various types of information, including the pages you visit, the emails you read, and other information.
    • This information is also used for:
      • Identify the User;
      • Register the User, in particular for an event;
      • Process the User's requests and orders and answer his questions;
      • Maintain contact with the User and provide him with a personalized service at all times;
      • Communicate with the User (by email, mail or otherwise) and send advertising materials or additional information about products, services, surveys, contests, promotions and special offers;
      • Learn more about the User's purchasing preferences;
      • Develop new products and services; and
      • Conduct market research and performance research to evaluate customer service, measure performance, enhance the User experience and improve products.
    • These cookies are varied; some of them expire when the User closes their browser and no longer have any effect, while others may be retained. The User can deactivate cookies at any time. In this case, Ludditech does not guarantee optimal functioning of Fizl and Fizl Services.
    • It is also possible to object to the recording of cookies by configuring your Internet browser. However, if you choose this option, you may not be able to fully enjoy Fizl and Fizl Services.

  11. INTERNATIONAL COMMUNICATIONS

    • It is possible that in certain situations, the User’s information is transferred to servers outside of Canada.
    • Ludditech may also share your personal information with third parties outside Quebec, in accordance with the terms of this Policy.
    • Ludditech will not share your personal information with third parties located in jurisdictions that do not offer a similar level of privacy protection as Quebec.

  12. SHARING PERSONAL INFORMATION

    • Ludditech undertakes not to sell the collected personal data without the User’s explicit consent. Personal data can exclusively be sold in the context of a partial or total disposal of Ludditech’s business to a third party. In such a situation, the disposed data is subject to the same warranties that those contained in this Confidentiality Policy.
    • Unless otherwise stated in this Policy, the personal information the User provides will not be transmitted to third parties without his permission. However, Ludditech sometimes shares this information with partners.
    • If the User does not wish to have his personal information communicated to third parties or partners, he may opt out at any time, as mentioned in the following section.
    • Ludditech may, exceptionally, disclose the User's personal information without the User's consent in the following circumstances:
      • When required by law, for example when a court order requires Ludditech to disclose the User's personal information.
      • When consent cannot be obtained and privacy laws allow Ludditech to disclose the User's personal information. This is particularly the case where the protection of the public interest so requires.

  13. RIGHT OF OPPOSITION AND WITHDRAWAL

    • Ludditech is committed to offering the User the right to oppose and withdraw his personal information.
    • The right of opposition is understood as the possibility offered to the Users to refuse allowing their personal information to be used for certain purposes mentioned regarding data collection.
    • The right of withdrawal is also understood as the possibility offered to the Users to request that their personal information no longer appears, for example, in a mailing list.
    • The User also has the right to request access to the personal information Ludditech has collected about him and to correct any information as needed by contacting the contact person in charge of data management whose information is listed in the section “CONTACT US” below.

  14. ACCES TO YOUR PERSONAL INFORMATION

    • Except as provided in this Policy, personal information collected by Ludditech under this Policy will only be accessible to authorized and competent employees of Ludditech.
    • Subject to certain exceptions, Ludditech may inform you of your personal information, how it is used and whether it has been shared with third party service providers. You will also be able to access this information to modify or delete it.
    • Your request for access must be made in writing and sent in accordance with the procedures set out in this section and in the “CONTACT US” section below.
    • Ludditech will acknowledge receipt of your request in writing and may ask you to confirm your identity before providing you with such information. Access to this information will normally be free of charge, but if you request a copy or transmission of your information, we may charge you a reasonable fee. Ludditech will inform you of the amount in advance and give you the opportunity to withdraw your application. Ludditech will provide you with access to your information within thirty (30) days of receiving your request or will inform you in writing that additional time is required to respond to your request.
    • In some cases, we may not be able to provide you with access to some or all of your information. If we are unable to do so, or if we are not permitted to do so by law, we will provide you with an explanation and indicate what other measures are available to you.

  15. SECURITY

    • The personal information Ludditech collects is kept in a secure environment. Ludditech has taken appropriate measures to maintain the confidentiality of personal information and to protect it against loss or theft, as well as its unauthorized access, disclosure, copy, use or modification – taking into account, in particular, its sensitivity and the purposes it is used for. In addition, Ludditech requires that each employee, proxy or representative of Ludditech complies with this Policy.
    • In order to ensure the security of the User’s personal information, Ludditech uses the following measures:
      • Secure Sockets Layers (SSL) protocol;
      • Secure access to premises;
      • Protected access to servers and computers;
      • Firewall;
      • Use of password-protected data networks;
      • Confidentiality agreements with employees;
      • Internal privacy policies;
      • Personal data protection procedures;
      • Routine updating of security measures;
      • Encrypted and secure electronic communications; and
      • Canadian server.
    • Ludditech is committed to maintaining a high degree of confidentiality by incorporating the latest technological innovations and thus ensure the confidentiality of the User’s transactions, in order to protect the User’s personal information and prevent it from being viewed, used or disclosed without authorization.
    • However, since no mechanism provides absolute security, some degree of risk is always present when communicating personal information over the Internet. If a password is used to protect the User’s account and his personal information, it is his responsibility to keep it confidential.
    • In the event of a privacy incident involving the personal information of a User held by Ludditech, Ludditech will notify the concerned User and the Quebec Access to Information Commission of any privacy incident that presents a risk of serious harm.

  16. FRENCH AND ENGLISH LANGUAGE

    • In the event of a definition or interpretation issue between the French and English versions of this Privacy Policy, the French version shall prevail.

  17. APPLICABLE LAW AND JURISDICTION

    • Fizl and its content are managed by Ludditech from its offices located in the province of Quebec in Canada. Fizl, Social Media and their content, Legal Notices, and their use by the User are all governed by the laws of Quebec and Canada that are applicable, without giving effect to any principle relating to conflict of laws. You agree that all matters and disputes concerning Fizl and your use of it shall first be brought before a mediator and, in the absence of a compromise, decided by the courts of Montreal. Notwithstanding any jurisdiction and applicable law, when the User is a consumer within the meaning of the Consumer Protection Act of Quebec, then any dispute relating to this Policy shall be governed by the law of the Province of Quebec and shall necessarily be brought before a competent jurisdiction in accordance with the rules of the Civil Procedure Code.

  18. CONTACT US

    • The User may exercise his rights provided in this Policy or he may address any other question or complaint regarding Ludditech’s privacy practices by contacting us at the following e-mail address: support@fizl.io. The Privacy Officer will contact you within thirty (30) days of receiving your email.

  19. INTERPRETATION

    • This Policy is governed by applicable Quebec and Canadian laws, including the Privacy Act of Canada. These laws apply without giving effect to any conflict of law principles.
    • Whenever the context so requires, any word written in the singular also includes the plural and vice versa; any word written in the masculine gender also includes the feminine gender and vice versa.

  20. DIVISIBILITY

    • Each provision of this Policy is a separate and distinct whole so that a court decision that any provision of this Policy is invalid or unenforceable will not affect the validity or enforceability of the remaining provisions of this Policy.

  21. AMENDMENT OF THIS POLICY

    • Ludditech may, from time to time, modify the Legal Notices and the additional terms or policies related to Fizl's Services. Ludditech will notify you of any significant changes to this Privacy Policy and the additional terms or policies that affect your rights under this Privacy Policy, through an email, a notice via Fizl's Services, or an update of the last update date indicated at the beginning of this Privacy Policy. Except where the Consumer Protection Act applies or unless otherwise indicated by Ludditech in this notice (if applicable), the changes take effect immediately upon posting of the updated Privacy Policy here or the modified additional terms or policies here (as the case may be). Your continued access to Fizl's Services or your continued use of Fizl's Services after Ludditech has given this notice, if applicable, or after Fizl has posted the updated Privacy Policy, constitutes your acceptance of the changes and your consent to be bound by the Legal Notices or the additional terms and policies, as they may be amended from time to time. If you do not agree with the modified Legal Notices or the additional terms and policies, you must cease accessing and using the services.
